KMK’s MTI Group represents trusts and claims resolution companies on all aspects of the claims resolution process, including:

Our MTI Group represents trusts and other entities that design, adopt and implement claims resolution procedures to handle disputes over claim qualification or claim value, and also claims resolution entities themselves. We routinely draft and implement procedures, advise clients on policy issues in connection with the implementation of claims resolution procedures, and mediate and arbitrate claims processed thereunder.  We have mediated thousands of contested claims for our trust clients.

We regularly advise our clients on claims processing issues, such as interpretation and application of statutes of limitations provisions and forecasting and monitoring of claims payment rates. We are involved in internal and external claims audits, and regularly have drafted claims audit protocols used by our clients.  The professionals in our claims resolution practice regularly advise clients on issues relating to claims payments and releases.  We have a broad base of knowledge relating to state law variations in estate representation requirements and documentation, release form requirements, and subsequent Medicare and related reporting requirements.

Our attorneys have decades of experience litigating complex matters relating to the claims resolution process in state, federal and bankruptcy courts, as well as in private arbitration. We are among a few firms with litigators experienced in representing 524(g) asbestos settlement trusts and other claims resolution companies as parties in litigation. We also have extensive experience and routinely responds to and defends our clients in connection with third-party discovery.
