Client(s): Duke Energy International, Inc.

The firm represented Duke Energy Corp in a class action alleging that violations of the federal antitrust laws and Ohio law governing public utilities against Duke and its wholly-owned subsidiaries.  Duke Energy filed its Motion to Dismiss plaintiff’s amended complaint for lack of jurisdiction and failure to state a claim.  The court agreed with defendants’ and dismissed plaintiffs’ amended complaint.  Plaintiffs appealed the lower court’s decision and appealed to the Sixth Circuit Court of Appeals.  Sixth Circuit Court reversed and the case later settled.
