We have represented creditors’ committees, future claims representatives, certified classes, and unofficial committees of claimant representatives in major mass tort bankruptcy cases.

Some of our significant engagements in mass tort bankruptcies, include:

G-I Holding Inc.
We acted as counsel to former state court Judge C. Judson Hamlin, the Future Claimants Representative in the G-I Holdings Inc. asbestos bankruptcy case filed in the United States Bankruptcy Court for the District of New Jersey. 

Babcock & Wilcox Company
We acted as counsel to a group of law firms acting as an unofficial committee in In re Babcock & Wilcox Company bankruptcy cases filed in the United States Bankruptcy Court for the Eastern District of Louisiana. Our lawyers represent claimants holding more than $50 million in settlement claims. 

Wallace & Gale Company
We acted as counsel to Asbestos Claimants Committee in the In re Wallace & Gale Company bankruptcy case filed in the United States Bankruptcy Court for the District in Maryland. A consensual plan was confirmed with the support of both the asbestos claimants and the debtor’s insurers, and a trust has been established to distribute proceeds from expected insurance recoveries. The settlement trust will be funded by cash and insurance recoveries. 

SGL Carbon
We acted as counsel to a large certified class of antitrust claimants in the In re SGL Carbon bankruptcy case filed in the United States Bankruptcy Court for the District of Delaware. The firm successfully asserted a class claim on behalf of the antitrust claimants, and KMK attorneys participated as members of the creditors’ committee.

Dow Corning
We acted as counsel to an MDL Steering Committee for TMJ implant victims in the In re Dow Corning bankruptcy case filed in the United States Bankruptcy Court for the Eastern District of Michigan, in which the plan of reorganization established a separate fund for other, non-breast implant tort claimants. 

Eagle-Picher Industries
We acted as counsel to the Personal Injury Claimants’ Committee in the In re Eagle-Picher Industries bankruptcy cases filed in the United States Bankruptcy Court for the Southern District of Ohio, in which the committee prevailed in an aggregate tort claims estimation proceeding. The claims estimation led to the confirmation of a plan of reorganization jointly filed by the asbestos committee and the debtors, whereby all the stock in the debtor corporations were placed in trust for the asbestos and lead victims. Currently, the firm serves as co-counsel for the Eagle-Picher Industries Trust, which has more than $500 million in assets.
