Township Builder Fee Challenged Once More

As reported in the June 9, 2011 edition of The Enquirer (page C1), Keating Muething & Klekamp partners, Charles M. Miller and Joseph L. Trauth, Jr. presented oral arguements yesterday before The Supreme Court of Ohio on behalf of its clients, Charleston Signature Homes, LLC, The Drees Company, Fischer Single Family Homes II, LLC, the Homebuilders Association of Greater Cincinnati, and John Henry Homes, Inc. The Supreme Court of Ohio will determine the legality of a so-called impact fee that plaintiffs argue is, in actuality, a double tax on new property developments in the township. The case is The Drees Company et al v. Hamilton Township, Ohio, et al.
