United States District Court Awards Cintas Corporation More Than $2.6 Million in Attorneys Fees and Costs Citing Egregious Conduct by EEOC

The law firm of Keating Muething & Klekamp PLL (KMK®) prevailed for its client, Cintas Corporation, in the awards phase of this case filed more than 11 years ago alleging employment discrimination. In an opinion filed August 4, 2011, the United States District Court, Eastern District of Michigan ordered the Equal Employment Opportunity Commission (EEOC) to pay Cintas more than $2.6 million in attorneys fees and costs.

Supreme Court's ruling allows pending case involving Rumpke's status as public utility under township zoning law to be decided by Court of Appeals

In a decision announced today, the state’s highest court ruled in favor of Keating Muething & Klekamp’s client that Colerain Township in Hamilton County is not a proper party and therefore not allowed to intervene in a lawsuit filed by Rumpke Sanitary Landfill, Inc.

The Supreme Court of Ohio decided today to hear the case, The Drees Company et al v. Hamilton Township, Ohio, et al, to determine the legality of a so-called impact fee that plaintiffs argue is, in actuality, a double tax on new property developments in the township.

Court agrees city ordinance contradicts Ohio law and is unconstitutional

Creighton, Jr., announced that six years of class action antitrust litigation has ended with court approval of two settlements totaling $38.25 million (USD) in what plaintiffs referred to as the “Plant for Paper” deal among competing companies in the international Pressure Sensitive Labelstock industry. The latest settlements bring the total recovered by plaintiffs to $46.5 million.

The United States Court of Appeals for the Sixth Circuit recently upheld a 2007 decision by the United States District Court for the Southern District of Ohio, Western Division, that Novelis Corporation — now a wholly-owned subsidiary of India-based Hindalco Industries Limited — is liable for copyright infringement in connection with transferring a Cincom Systems, Inc. software license through a corporate restructuring without Cincom’s prior written approval, in Cincom Systems, Inc. v. Novelis Corp., 581 F.3d 431 (6th Cir. 2009).

Hamilton County Common Pleas Judge Norbert Nadel ruled today in Rumpke Sanitary Landfill, Inc. v. State of Ohio that portions of House Bill 562, the Capital Appropriations Bill, are unconstitutional. The bill contained a rider that would disallow private sanitary landfills in counties and townships from seeking public utility status. Rumpke’s attorney, Joseph L. Trauth, Jr. of Keating Muething & Klekamp law firm, argued that those riders violated Section 15(D), Article II of the Ohio Constitution which states, “No bill shall contain more than one subject, which shall be clearly expressed in its title.”

James E. Burke and Charles M. Miller, attorneys at Keating Muething & Klekamp (KMK), won an unanimous decision today from the Ohio Supreme Court which issued the Writ of Mandamus KMK requested. [2008-1842. State ex rel. Myles v. Brunner, Slip Opinion No. 2008-Ohio-5097.] The Ohio Supreme Court ruled 7-0 in favor of two Hamilton County voters KMK represented who wished to have their McCain-Palin absentee ballot applications accepted by the Hamilton County Board of Elections. Because of the efforts of these KMK attorneys, thousands of predominately elderly voters across Ohio will receive absentee ballots.

Charles M. Miller, a Keating Muething & Klekamp (KMK) attorney, won an unanimous affirmance from the Ohio Supreme Court in In re Adams, 115 Ohio St.3d 86, 2007-Ohio-4840. Mr. Miller is appellate counsel for the Adams children, who are in the process of being reunited with their parents. A county children''s services agency attempted to appeal from an order denying the agency''s motion for permanent custody of the children. Mr. Miller prevailed in his argument that an agency cannot appeal from the denial of a motion for permanent custody.

Charles Miller, a Keating Muething & Klekamp (KMK) attorney, won a reversal from the Ohio Supreme Court. In a 6-1 decision written by Chief Justice Thomas J. Moyer, the Supreme Court agreed with Miller’s argument that an attempted possession of illegal drugs is a drug-abuse offense, and is subject to the mandatory sentencing provisions set forth for drug-abuse offenses.

Earlier this fall, an anonymous donor established a $25,000 John L. Muething Scholarship Fund at Covington Catholic High School. Upon hearing of the scholarship fund, the Muething family donated an additional $20,000, and Keating Muething & Klekamp (KMK) contributed an additional $5,000. The $50,000 scholarship fund will help pay tuition for students who could not otherwise afford to attend the private school.

Their mission is to develop and manage a system of quality mental health services responsive to individual and family needs and differences. Under state law, the Board is the county government agency responsible for planning, funding and evaluating the effectiveness of community mental health services available to Hamilton County residents. Keating, Muething & Klekamp recently represented Provident Bank and Provident Consumer Financial Services in a successful defense and appeal to the United States Court of Appeals for the Eleventh Circuit in an action styled Regions Bank v. The Provident Bank, Inc., et al. This is a case of first impression which broke new legal ground in defining the rights and liabilities of commercial parties to wire transfer transactions under Article 4A of Uniform Commercial Code.
