Keating Muething & Klekamp's Client Granted Summary Judgment in Federal Court Employment Case

On April 12, 2011, Judge Arthur Spiegel of the United States District Court for the Southern District of Ohio granted summary judgment in favor of The Kroger Co. on all claims brought against it by Jacqulyn Gray, a former employee. In dismissing Gray's federal and state claims for age discrimination, ERISA discrimination, FLSA retaliation, FMLA retaliation, and violation of Ohio public policy, the court credited Kroger's argument that it had lawfully terminated Gray's employment after conducting a thorough investigation into her policy violations and held that Gray had failed to show that Kroger's proffered reason for her termination was pretext for discrimination or retaliation.
