President Obama’s fiscal year 2011 budget includes an $8 billion line item for the enforcement of laws relating to employee misclassification as independent contractors. Similarly, the U.S. Department of Labor has requested a significant increase in funding for additional investigators. At the same time, the volume of class litigation over exemption misclassifications has never been higher. Hopes that the litigation explosion of wage and hour cases will ease are misplaced.
While determining whether an employee is exempt or an independent contractor is very fact-specific, you can only do this analysis if you understand what the law requires. Misclassification is widespread and can cost employers tens of thousands of dollars in civil, as well as, criminal penalties.
