Dudenhoefer v. Fifth Third Bancorp

KMK successfully obtained dismissal of the entirety of plaintiffs’ complaint, which alleged claims brought under ERISA for breach of fiduciary duty arising out of defendants’ continued holding of, and investment in, Fifth Third stock in the 401(k) Plan despite decreases in stock value resulting from the sub-prime lending crisis.  The case subsequently settled.
